Schlie�lich war es, gemeinsam mit zahlreichen weiteren Autoren, seine vehemente Kritik an der bisherigen Rechtsprechung, die diese Wende erst begr�ndet hatte. Das durchaus heikle Thema, mit dem sich der OGH nun bereits zum dritten Mal, dieses Mal aber mit einer deutlich ge�nderten Rechtsansicht, besch�ftigt, ist jenes der Entlohnung der Genealogen in �sterreich. Dieser Berufsstand wird in dem f�r die Zwecke dieser Arbeit interessanten Fall dann aktiv, wenn eine scheinbar erbenlose Erbmasse einem tats�chlich vorhandenen, jedoch nur schwierig auffindbaren Erben zukommen soll. Es ist an ihnen, diese potentiellen Erben ausfindig zu machen, ihre Erbenstellung nachzuweisen und schlie�lich die Auszahlung des Erbes an diese zu veranlassen. Dass die Genealogen f�r diese Dienstleistung eine entsprechende Entlohnung verlangen, ist dabei ebenso wenig ungew�hnlich, wie die Praxis, dass diese Entlohnung zumeist als ein vertraglich festgelegter Prozentsatz der Erbmasse erfolgt. Das dabei mitunter Prozents�tze von �ber 30% vereinbart werden, mag auf den ersten Blick zwar hoch erscheinen, zu bedenken ist allerdings, dass die Genealogen zu Beginn ihrer Arbeit die absolute Gr��e des Erbes nicht kennen und mit diesem prozentualem Honorar ein nicht unerhebliches Risiko eingehen. Schon viel eher ungew�hnlich - und damit n�hern wir uns dem Kern der Problematik mit der sich diese Arbeit besch�ftigt - ist oder besser war, dass die Genealogen bis zur oben erw�hnten Entscheidung des OGH sich einer ebenso hohen Entlohnung sicher sein
