Excerpt from Die Befreiung von Gefangenen: Eine Erg�nzung zum Ersten Bande der auf Anregung des Reichsjustizamtes Herausgegeben Vergleichenden Darstellung des Deutschen und Ausl�ndischen Strafrechts (Besonderer Teil) Der Grundsatz, da� die Selbstbefreiung straflos ist, wird von allen Landes gesetzen anerkannt, aber zum Teil mit sehr erheblichen Einschr�nkungen. So haben die preu�ischen Entw�rfe bis 1843 die Selbstbefreiung durch Ge walt an Sachen oder Personen unter Strafe gestellt weil sie mindestens t�t liche Widersetzlichkeit sei. "die immed.-kommission hielt aber eine Vor schrift hier�ber f�r unn�tig, da es unzweifelhaft sei, da� die Befreiung durch das Mittel der Gewalt oder durch andere an sich strafbare Mittel die Strafe der hierdurch ver�bten Verbrechen oder Vergehen nach sich ziehe und es einer besonderen Strafbestimmung sonach f�r diese Art der Selbstbefreiung nicht bed�rfe. 3) Dem gleichen Gedanken geben mehrere Staaten, die die Selbstbefreiung straflos lassen in ihren Gesetzen Ausdruck. Dagegen be strafen Baden 5 636, Th�ringen Art. 106, Sachsen 1855 Art. 153 (ebenso 1868) und Bayern 1861 Art. 143 die mit t�tlicher Gewalt oder mit Drohungen gegen die Aufseher bewirkte Selbstbefreiung als solche. Nach dem W�rttem bergischen stgb. (art. 181) sind strafbar "gefangene, welche sich mittelst gewaltsamen Ausbruches oder im Komplotte mit anderen Gefangenen aus der obrigkeitlichen Gewalt befreien. Ebenso stellen Sachsen 1838 Art. 109 und Hessen Art. 201 die Selbstbefreiung im Komplott unter Strafe. 5) Dagegen findet sich der Tatbestand der Gefangenenmeuterei im Sinne Preu�ens fast nirgends wohl aber statt dessen eine Verweisung auf die Aufruhrbestimmungfi) Wir werden im Laufe der Darstellung Grund finden, diese von Preu�en ab weichende Regelung de lege ferenda zu bef�rworten.
