Excerpt from The Trials of Arthur Thistlewood, James Ings, John Thomas Brunt, Richard Tidd, William Davidson and Others, for High Treason, Vol. 2 of 2: At the Session House in the Old Bailey, on Monday the 17th, Tuesday the 18th, Wednesday the 19th, Friday the 21st, Saturday the 22d, Monday the 24th, Tuesday the 25th, Wednesday the 26th, Thursday the 27th, and Friday the 28th of April, 1820 And first, Gentlemen, with respect to the indictment itself. It contains different counts or charges which are founded upon two particular statutes; the first being ancient statute, to which you have already been frequently referred, and which passed in the reign of Edward the Third and the other a more recent Act, which passed in the reign of his late Majesty. And, in the outset, and before I draw your attention to any part of the evidence, I shall state to you what in substance the nature of these dif ferent charges is, disentangled from technical and artificial statement; the first count is compassing and imagining to depose the King, which is made treason by the statute which passed in the reign of his late Majesty, the 36th Of George the Third, and the overt or open acts stated in the indictment, are manifestations of a secret intent; for it is in the intention that the crime of high treason consists. The treason alleged, is compassiug and imagining to depose the King, and the Oven acts are in themselves such, all or some of them, as are in point of law suficient to bring the case in point of law within the treason charged, supposing the overt acts themselves to be 'as matter of fact, made out by sullicient and satisfactory proof. Passing Over the second, the third count is a charge fdf conspiracy to levy war against the King, in order to coupel His Majesty to change his measures, 'and with respect to this also, I have to state, that here again the overt acts 'which are stated in support of this count, are clearly sufficient to make out the charge in point of law, if the acts themselves be established by the testimony before you.
