Cap. 32 (1920) With Notes Thereon, Together With All Practice Decisions Since the Publication of Vol. II This section is intended to provide in gen'eral terms, _for all the cases in which there is an appeal from judgments of the highest Court of final resort in any province. It is wider in its scope than old section 36, in that it' does not require that the judgment appealed from should be in an action commenced in a Superior Court. It is narrower than-the old section, in that it debars appeals, where the matter in controversy does not amount in value to but the extensive power given to the highest Court of final resort to grant leave to appeal, more than compensates for any restriction on the former jurisdiction of the Court.
