Die beiden Autodidakten verfahren aber dabei nicht planlos, wie man das so h???ufig bei einem derartigen Bildungsgange findet, sondern sie schufen sich ihre eigne Methode. Wann irgend in einer Wissenschaft, so war dies gerade bei der Jurisprudenz durchaus notwendig; bei dem ungeheuren Wust von Gesetzen, die Byzanz besafs, konnte ein Anf???nger leicht den rechten Weg verfehlen; deswegen hatte ja auch schon Justinian genaue Vorschriften ???ber das Studium des Rechts Und wie hatte sich seit dieser Zeit der Umfang dieser Wissenschaft vergr???fsert durch eine ganze Anzahl neuer Novellen! In der Vorrede zum Proohirum klagen die Kaiser Basilius I., Constantin und Leo, das geschriebene Recht habe einen so grofsen Umfang erreicht, und sei ???berdies durch verschiedene Gewohnheite rechte so ersch???ttert werden, dafs sich das ganze b???rgerliche Recht im Zustande der Ver wirrung befinde. Nun war zwar darin Abhilfe geschafft worden, man weifa, da??? zu diesem Zwecke die Basiliken abgefafst werden eine Zusammenstellung dessen, was vom Justinianischen Rechte noch brauchbar war, ohne grofse und neue Ideen, an das mona mentale Werk des Codex bei weitem nicht heranreichend deutlich zeigend dafs die sch???pferische Kraft in der Jurisprudenz dahin allein die Basiliken waren oft in Folge ihrer K???rze dunkel, 8) und man bedurfte zu ihrer Interpretation erst recht der Justinianischen Gesetzgebung und der vielen Ausleger derselben; denn auch der Codex war nicht sllent halbcn so klar abgefafst, dafs nicht mehrfache Auslegungen ein und derselben Stelle exi stierten. So hatte man zwei Gesetzgebungen nebeneinander, die sich gegenseitig erg???nzten. Und die Juristen erhalten sich bei der ???lteren und ihren Auslegern Rat, wenngleich beim F???llen des Urteils nur auf die Basiliken Bezug genommen werden durfte. Kein Wunder daher, wenn bei solchen Zust???nden in den Gerichten viel Zank und Streit, im allgemeinen Unsicherheit des Rechts herrschte. Erst allm???hlich 9) verloren die J ustinianischeu Gesetz b???cher, die man ???berdies in der Zeit des 11. Jahrhunderts schon l???ngst nur in ihren griechischen Bearbeitungen benutzte, ihre Geltung. Als die beiden J???nglinge studierten, da betrieb man das Studium des Rechts auf ganz banausische Art. Man pr???gte sich die Gesetze so gut als m???glich ein, man schw ur auf diesen oder jenen Ausleger, man handhabte die Gesetze mit der Hand des Anatomen, nicht des Physiologen, man ???bte keine verst???n dige Kritik.
