County judge hat poteen of a circuit judge at chambere--Jlny order payment of suit money and temporary alimony in divorce suit pending in circuit court--Sight of persons commitkdfor contempt, to jail liberties. 1. The acts of the legislature of this state conferring upon the county judge the powers of a circuit judge at chambers, are valid. 2. In this state the courts are deemed to be always open for the purpose of motions, except motions for a new trial on the merits. And an order of a county judge or court commissioner operates as an order of court, with the exception above named and that of an order to stay proceedings after verdict. 3. Either the circuit judge at chambers or the county judge may, therefore, in a divorce case pending in the circuit court, order payment to the wife by the husband of suit money and temporary alimony, and restrain him from interfering with her personal liberty. 4. Since ch. 4S3, Laws of 1864, took effect, on a commitment for contempt under sec. 4, oh. 149, It. S. (for a refusal to obey an order of court directing the payment of money), the prisoner is entitled to the jail liberties. 5. Whether, where the precept directs the commitment of the party in contempt "to close custody in the jail without being allowed the liberties thereof," it is wholly void, or void only so far as unauthorized, quart.
