Hersey: Indicted for the Murder of Betsy Frances Tirrell, Before the Supreme Judicial Court of Massachusetts; Including the Hearing on the Motion in Arrest of Judgment, the Prisoner's Petition for a Commutation of Sentence, the Death Warrant, Officer's Return Upo And that George C. Hersey, of Weymouth, in the county aforesaid, on the day and year aforesaid, and before the time when said Betsy Frances Tirrell feloniously, wilfully, and of her malice aforethought, herself did then and there, in manner and form aforesaid, kill and murder; did counsel, procure, hire, incite and persuade her, the said Betsy Frances Tirrell, then and there feloniously, wilfully, and of her malice afore thought, to kill and murder herself in manner and form afore said, against the peace Of said Commonwealth, and contrary to the form of the statute in such case made and provided. And so the jurors aforesaid, on their oath aforesaid, do say and present, that the said George C. Hersey, her, the said Betsy Frances Tirrell, at Weymouth aforesaid, in the county aforesaid, in manner and form aforesaid, and by the means aforesaid, on the day and year aforesaid, feloniously, wilfully, and of his malice aforethought, did poison, kill and murder, against the peace Of said Commonwealth, and contrary to the form of the statute in such case made and provided. And the jurors aforesaid, on their oath aforesaid, do further say and present, that the Said George C. Hersey, at Wey mouth aforesaid, in the county aforesaid, on the day and year aforesaid, in and upon said Betsy Frances Tirrell, wilfully, feloniously, and of his malice aforethought, did make an as sault, and the said Betsy Frances Tirrell, in some way and manner, and by some means and agencies, to the jurors not known, did deprive of life, so that the said Betsy Frances Tirrell then and there did die: and so the jurors aforesaid, upon their oath aforesaid, do say and present, that the said George C. Hersey, her, the said Betsy Frances Tirrell, then and there feloniously, wilfully, and of his malice aforethought, did kill and murder, against the peace of the Commonwealth aforesaid, and contrary to the form of the statute in such case made and provided. Very Good. First edition. 8vo. Bound in contemporary black cloth. Gilt lettering on spine. Good binding and good cover. Minimal wear to extremities. Chipping and loss to head and tail of spine. Splitting starting on front board. Contemporary gift inscription on FEP, by the defense attorney, George S. Sullivan, who presided over the case. Clean, unmarked pages with minimal toning. "Hersey had been living in Weymouth [Massachusetts] with the Tirrell family since the sudden death four months before of their daughter and his fiancee, Mary Tirrell. A second daughter, Betsy became pregnant by him, and he gave her a drug which he represented would cause an abortion. Actually, it was strychnine which he had obtained in Boston allegedly to poison a dog. He was convicted and hanged. The preface claims this to be the only (in 1862) published trial in which strychnine was detected by analysis in the deceased.": McDade, The Annals of Murder 472.
