A summons may be taken out by any person in any matter, whether contentious or non-contentious, in which there is no rulo or practico requiring a different mode of proceeding. 99 C. 15. A printed form must be obtained and filled up with the object of tho summons, and a proper feo stamp affixed. It must then bo taken to the clerk of the papers, whe will insert in the blank loft in tho printed form the time when the summons is to be made returnable, and got the summons signed by a registrar. 100 C. li. The clork of the papers is then to enter the namo of the causo or mattor and of the agent taking out the summons in the summons book, and return the summons (with the stamp cancelled), signod, to tho applicant, who is to servo a copy on the party summonod. This copy must be served on the party summoned one clear day at least beforo the summons is returnable, and before 7 p.m. On Saturdays the copy of the summons is to bo served before 2 p.m. 101 C. B. On tho day and at tho hour named in the summons the party issuing the same is to present himself with tho original at tho judge's chambers. 102 C. B. Both parties will be heard by the judge, whe will make such ordor as ho may think fit, and a note of such order will be mado by tho registrar in the summons book. i R. S. C. 1883. 103 C. B. If the party summoned do not appear after tho lapso of Default of half an hour from tho time named in tho summons, the party taking appearance, out tho summons shall be at liberty to go before the judge, who will thereupon make such order as ho may think fit.
