Hed. 675; Baillie 620. Executor 100. It is not necessarv that the executor of the will Maz b'a of a Mahomedan should be a Mahomedan. A Mahomedan may appoint a Christian, a Hindu, or any non-Moslem as his executor: Afoohummud Ameenoodeen v. Afoohummud Kubeeroodeen (j); Henry Imlach v. Znhooroonnisa (k). Powers of eteeeutors 101. The powers and duties of the executors of a Mahomedan will are now determined by the provisions of the Probate and Administration Act, in cases in which that Act applies. Per Sargent, CJ., in Shaik Moosa v. Shaik E, sa (l). The Probate and Administration Act, 1881, applies amongst others to Mahomedans. Before the passing of that Act, the powers and duties of Mahomedan executors were determined by the Mahomedan law; since the passing of that Act, however, they are determined by the provisions of that enactment. The provisions of the Probate and Administration Act are now extended almost to the whole of British India, and it is therefore thought unnecessary to set out the rules of Mahomedan law on the subject. It is important to note that when there are several executors, the powers of all may, in the absence of any direction to the contrary in the will, be exercised by any one of them who has proved th? will (Probate Act, s. 92).
