Der Gesetzgeber konnte nur auf Erfahrungen zur???ckgreifen, die in der Bundesrepublik Deutschland seit 1950 mit der freiwilligen Aufstellung und Ver???ffentli chung von Konzernabschl???ssen einiger gro???er Konzerne vor allem aus den Bereichen der Montan-, Chemie- und Elektroindustrie gesammelt worden waren; im Ausland boten besonders die Vorschriften der nordamerikanischen Securities and Exchange Commission ???ber die Konzernrechnungslegung manche Anhaltspunkte. So betrat der Gesetzgeber - wie es in der Begr???n dung zum Regierungsentwurf des Aktiengesetzes ausdr???cklich hei???t - mit den Vorschriften ???ber die Aufstellung von Konzernabschl???ssen Neuland; daher schien es ihm angebracht, vorsichtig vorzugehen. Dennoch sind trotz der gr???ndlichen Beratung des Gesetzes M???ngel nicht ausgeblieben: Viele Einzelfragen der Konzernbilanzierung bleiben v???llig offen; manche Probleme lassen sich ???berhaupt nicht sinnvoll l???sen, wenn das Ergebnis im Einklang mit dem Wortlaut des Gesetzes stehen soll. Einige Vorschriften sind - ge messen an den in der Begr???ndung angegebenen Zielen der Kodifizierung des Konzernabschlusses- sogar offensichtlich verfehlt. Der Wirtschaftspraxis und der Fachwissenschaft bleibt es nun ???berlassen, f???r die auftretenden Probleme des Konzernabschlusses L???sungen zu finden, die dem Zweck des Aktiengesetzes entsprechen und Wege zu einer sp???teren Reform des Gesetzes weisen. Nachdem im Jahre 1968 f???r das Gesch???ftsjahr 1967 zum ersten Male Kon zernabschl???sse nach dem neuen Recht ver???ffentlicht worden sind, liegen erste Erfahrungen mit den neuen Vorschriften des Aktiengesetzes vor.
