In wartime, reason and history both suggest that this balance shifts to some degree in favor of order-in favor of the government's ability to deal with conditions that threaten the national well-being. One of the purposes of this book is to review the long established traditional legal and policy themes associated with Global/National security law and to see how those norms were applied to the War on Terror. Since national security law rests upon a global rule of law regulating the lawful use of force, the term Global/National security law deals with all those customary and legal norms and standards associated with maintaining peace and responding to aggression. A second purpose of this book is to look at American domestic legal and policy responses to the War on Terror. While it is certainly true that the War on Terror saw the United States craft a variety of robust antiterrorism responses designed to disrupt the terrorist networks and prevent future terrorist attacks from occurring, all of these actions were well within acceptable legal constructs - both under domestic and international law. Some of these actions included the passage of the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act (USA PATRIOT Act); the creation of the Cabinet level post of Homeland Security; the establishment of United States Northern Command, in Colorado; the preemptive use of military force against the Iraqi regime of Saddam Hussein; and the indefinite detention of certain unlawful enemy combatants. At the end of the day, terrorism, like crime and war, can never be eradicated by mankind. In this context, even if one is cynical enough to believe that the world politic is ruled primarily by the application or threat of force, it is nevertheless of critical importance from both a national and international perspective that America rubricate its leadership role by thoughtful concerns for the positive advancement of the rule of law and the protection of cherished civil liberties. While a new body of law called terrorism law has emerged to deal with myriad legal issues associated with terrorism, the bedrock of Global/National security law remains firm. It is vital that lawyers skilled in both legal disciplines become involved in the national effort to protect the homeland and civil liberties"--
