But then he sketches a plan by which the Judges are to be employed by the King as a kind of provincial police under the Chancellor as Head Inspector: a plan tolerable, perhaps, under the sway of a perfect Ruler, but likely to be perverted to the most oppressive purposes under a needy and prodigal Sovereign, driven to doubtful or illegal expedients for the sake of procuring money without recourse to Parliament-In Bacon's theory, however, the King was not to use the Judges as his instruments, but rather as his counsellors: 1 Sec above, p. 24. " Let the King take a care (and, as much as in you lies, do you take care for him) that the Judges of the Law may always be choseu of the learnedst of the profession (for an ignorant man cannot be a good judge) and of the prudentest and discreetest, because so great a part of the Civil Government lies upon their charge. And indeed little should be done in legal consultation without them, and very much may be done by their prudent advices, especially in their Circuits, if right use were made of them... if the King, by himself (which were the best) or by his Chancellor, did give them the charge according to occurrences at their going forth, and receive a particular accompt from them at their return home.
