Although it is clear, that the Education Act will in large boroughs be almost practically inoperative without the enactment of a bye-law, yet it must not be forgotten, that it will be extremely difficult to enforce its observance by the imposition of a penalty on a (a) The school board may appoint an officer or officers to enforce the observance of any bye-laws. (Sec. 36.) parent in those cases, (not infrequent, ) where the wages earned, or the household services rendered, by a child under thirteen years of age, are actually necessary to prevent a respectable hard-working father from becoming a pauper. The importance of educating the poor on the one hand, and the practicability of carrying out a J compulsory bye-law on the other, without other exemptions from non-attendance than those mentioned in the statute, or-without limiting compulsory attendance to an age under thirteen, will require the serious consideration of members of a school board. CHAPTER XL School Fund, Expenses, and Audit. 1.--School Fund And Expenses. school The expenses of the school board under this Act Fund. 1. shall be paid out of a fund called the school fund. There shall be carried to the school fund all monies received as fees from scholars, or out of monies provided by parliament, or raised by way of loan, or in any manner whatever received by the school board, and any deficiency shall be raised by the school board as provided by this Act. (33 and 34 Vie., chap. 75, sec. 53.) Deficiency Any sum required to meet any deficiency in the out of school fund, whether for satisfying past or future Rates. liabilities, shall be paid by the rating authority out of the local rate.
