The study shows how this legal maxim, which is important for economy and credit system, found its way into the law, the history of which is placed in the last third of the 19th century. German description: Deckungs- und Ubernahmeprinzip bilden den tragenden Pfeiler unseres Zwangsversteigerungsgesetzes. Dingliche Belastungen, die dem Recht des Glaubigers, welcher die Grundstucksversteigerung betreibt, im Rang vorgehen, werden von der Versteigerung nicht beruhrt. Die Aufnahme dieses fur das Wirtschafts- und Kreditwesen wichtigen Rechtsinstituts in das Gesetz, dessen Geschichte im letzten Drittel des 19. Jahrhunderts neben die des Burgerlichen Gesetzbuches tritt, war angesichts gegensatzlicher Grundsatze im damaligen Partikularrecht keineswegs selbstverstandlich. Heftige Diskussionen juristischer, wirtschaftlicher und sozialpolitischer Natur gingen voraus.
