Ein Diskursstrang dreht sich dabei um die Frage, ob T???ter, deren Tatmotivation ma???geblich auf fremdkulturellen Anschauungen und Wertvorstellungen beruht, einer vermeintlich zur besonderen Milde gesonnenen Strafgerichtsbarkeit begegnen, welche bei der Strafzumessung, aber auch bereits bei der Strafbarkeitsbewertung die kulturellen Tatmotive t???terg???nstig ber???cksichtigt. Vielfach ist in diesem Ph???nomenzusammenhang in der medialen Debatte von einem "kulturellen Bonus" die Rede. Die Bezeichnung als Bonus, die origin???r das gute, gedeihliche oder gl???ckliche meint und auch nach herk???mmlicher Begriffsbestimmung positiv konnotiert ist, wird in dem hier interessierenden Zusammenhang dysphemistisch gebraucht. Der mit dieser Begriffsbenutzung einhergehende Vorwurf lautet vorwiegend dahingehend, dass derjenige T???ter, der eine Tat ma???geblich aufgrund kultureller Wertvorstellungen begeht, welche den in Deutschland vorherrschenden Wertvorstellungen fremd sind und gerade aufgrund dieser fremdkulturellen Tatmotivation eine strafmildernde strafgerichtliche Behandlung erf???hrt, letztlich zu Unrecht diesen strafrechtlichen bzw. strafzumessungsrechtlich relevanten Vorteil, also einen ungerechtfertigten Bonus erh???lt. Dabei liegt dem Vorwurf des Bonus die Bef???rchtung zugrunde, dass eine Strafgerichtsbarkeit, die die fremdkulturelle Tatmotivation t???terg???nstig ber???cksichtigt, partiell die strafgesetzlichen Normbefolgungsanspr???che zur???cknimmt und dadurch letztlich die der inl???ndischen Rechtsordnung inh???renten Wertvorstellungen preisgibt, indem fremdkulturelle Wertvorstellungen zum Ma???stab f???r die Strafbarkeitsbewertung und Strafbemessung erhoben werden.
