At ports in which agents are not required to be licensed, an importer can authorise a company as such to act as his agent. A minor can act as agent when above eighteen years of age. Seo Section 20. But it is very inadvisable he should do so, and the Customs will not issue a license to a minor. 181. Any officer may require from any agent the production of his written authority from the principal for whom he claims tx act, and in default of the production of such authority may refuse to recognise the agency. All such persons are required to produce written authority from their principals. Such authority is not required on each occasion, but usually a standing authority is handed to the Customs and filed. It is very necessary that Customs officers should require the deposit of agents' authority, as otherwise in many cases where it is important to do so, the difficulty of proving the connection between the agent and principal would be considerable. This precaution is the more necessary because the Act throws the liability on the owner for the declaration made by his agent. See Section 183. These authorities are Powers of Attorney, and if signed out of Australia may be required to be attested by a notary. A power purporting to be given by an Attorney of a company should contain the name of the Company only and not that of the Directors, as it is the power of the Company.
