N. to drown and suffocate, (" drown, suflbcate, or strangle,") with intent then and there, and thereby, feloniously, wilfully, and of his malice aforethought, the said J. N. to kill and murder; against the form of the statute in such case made and provided, and against the peace of our lord the King, his crown and dignity. fldd a count charging generally that the defendant did attempt to drown J..N'., &-c. Felony, death. 9 G. 4, c. 31, s. 11. App. This sentence may be recorded. 4 G. 4, c. 48. App. Evidence. Prove the attempt to drown, as stated in the indictment, and the intent, as directed ante, p. 344. Commencement as ante, p. 345.--in the county aforesaid, a certain gun, then and there loaded with powder and divers leaden shot, which he the said J. S. in both his hands then and there had and held, at and against one J. N., then and there feloniously, unlawfully, and maliciously did shoot, with intent, &c., as in the last precedent. fldd counts for shooting with'intent to maim, &c., as post, p. 352.
