These include zoning, expropriation, licensing, third party liability, safety regulation, mandatory insurance and criminal sanctions. The authors pay particular attention to the interrelationships of these instruments and their various economic effects. Using a comparative law and economics methodology, they are also able to incorporate environmental law with international policy and investigate the many diverse rules of the legal system and their implementation in different countries. Crucially, the authors do not consider economics as the exclusive determinant in legal rule-making. This book introduces the concepts of environmental economics, as well as some basic concepts in law and economics. The perspective is welfarist (and yes, some of the ethical discussions surrounding utilitarianism are brought up). Throughout the book, basic concepts such as consumer surplus are introduced, and various legal doctrines are discussed. Many examples and case studies (from Europe as well as the US) are provided.
Or, to put it more succintly: it does what is says on the tin. This is an introduction to the Economic Analysis of Environmental Law and Policy. And, though it takes a very qualitative principle-based hand-waving approach (as opposed to presenting proper, testable mathematical models), it is a good one at that.
The environment would be a lot cleaner if only this was read (and understood) by policymakers and analysts.
