In practice the term is most frequently (though not exclusively) applied to such departure, neglect, or informality as does not affect the validity of the act done. Thus an ivregular distress is not now vitiated, so as to make the distrainer a trespasser ab initio, and so to render all his proceedings illegal from the first; but where distress is made for rent justly due, any subsequent irregularity will do no more than give an action for damages to the party grieved, and not even that, if tender of amends is made before action brought. This is by 11 Geo. 2, c. 19, s. 19. Formerly, any irregularity made the party distraining a trespasser ab initio. 3 Steph. Com. ab Initio; Distbess; Six CarPenters' Case. IRREPLEVIABLE, or IRREPLEVISABLE. That which cannot be replevied or set at large upon sureties. replevin. IRREVOCABLE.
