But when the Turks conquered Constantinople, the Twelve Tables and the Institutes gave place to the Koran as a system of law. The unwillingness of the powers of Europe to submit their subjects to such a system--or want of system--of jurisprudence, led to the establishment of consular courts in Ottoman countries, with civil and criminal jurisdiction over the subjects or citizens of the nationality to which the particular capitulation was granted. The first was made to France, from which circumstance all Christians in the Ottoman dominions came to be called Franks. As intercourse with Asia grew, the same system of consular courts, with extraterritorial jurisdiction, was adopted there. These concessions proved to be of great importance to Americans residing in those countries. Congress created consular courts to exercise the granted powers, both civil and criminal. In the latter it was a necessity that proceedings should be instituted against persons accused of murder, without the intervention of a grand jury, and that they should be tried without a petit jury. Some strict constructionists in Congress and elsewhere questioned the constitutionality of such proceedings. This decision of the Supreme Court, announced by Mr. Justice Field, has set at rest all such questions.
